How to Get a Nail Technician License in West Virginia

West Virginia licenses nail technicians through the State Board of Barbers and Cosmetologists, under Article 27 of Chapter 30 of the West Virginia Code.

The training requirement is written directly into the statutory definition, which is unusual and useful: “Nail technician” or “manicurist” means a person licensed under the provisions of this article who engages in the practice of nail care and has completed 400 clock hours of training.

The 400 hours are not in a regulation the Board can amend — they are part of what the word means in West Virginia law.

Training Requirements

West Virginia requires 400 clock hours of training for a nail technician licence, stated in the statutory definition at W. Va. Code s. 30-27-3(w).

Because the figure sits in the definition of the profession rather than in an administrative rule, changing it requires an act of the Legislature.

The Statute Has Two Versions

This is a genuine legal curiosity worth knowing if you are researching West Virginia requirements. The Code carries a note that s. 30-27-3 was amended by two bills passed during the 2020 Regular Session of the Legislature, and that because neither bill expressly recognized the other's action, the Legislative Manager makes no determination as to the appropriate legal effect of the two acts.

Both versions are set out in the published Code. House Bill 4607, passed last on 7 March 2020, is the version that carries the 400-hour nail technician definition quoted above.

West Virginia's Other Credentials

Section 30-27-3(z) lists the professional licences West Virginia issues: aesthetician, barber, barber crossover, barber permanent wavist, cosmetologist, cosmetologist crossover, hairstylist, and nail technician.

The crossover credentials are worth noting. A cosmetology crossover is someone who has completed 1,800 clock hours, holds a cosmetologist licence, and completes an additional 300 hours in clipper cuts and face shaving to perform barbering — 2,100 hours in total.

Nail Technician Exam Requirements

West Virginia uses the NIC Nail Technology examinations, administered by Prov, Inc., in both a written and a practical component.

Prov's West Virginia bulletin states the written exam fee is $99 and the practical exam fee is $95. Against a $35 licence fee, examination is by some distance the dominant cost of entering the trade in West Virginia — roughly $194 in testing against $35 to the Board.

How to Renew Your West Virginia Nail Technician License

West Virginia nail technician licences renew annually for $35 — among the lowest annual fees in the country.

No Continuing Education

West Virginia does not require continuing education hours for nail technician renewal. The annual fee is the whole cost of keeping the licence active.

Annual Rather Than Biennial

West Virginia is one of a minority of states on a one-year cycle, alongside Louisiana, Maine, New Mexico, North Dakota and South Dakota. At $35 the cost is modest, but the deadline comes round every year.

The Board Also Issues Work Permits

What a Nail Technician Can Do in West Virginia

West Virginia defines nail care precisely at W. Va. Code s. 30-27-3(v), as any one or any combination of the following acts when done on the human body for compensation and not for the treatment of disease:

  1. The cleansing, dressing, or polishing of nails of a person
  2. Performing artificial nail service
  3. The cosmetic treatment of the feet up to the knee and the hands up to the elbow

Three points follow from that wording:

  • The boundary is the knee and the elbow. West Virginia gives the same reach that Utah, Nevada and North Dakota do, so the full arm and leg work of a spa service is inside the licence.
  • Artificial nail service is named separately. Enhancements are inside the scope without needing to be inferred from “dressing” the nails.
  • “Not for the treatment of disease” is the outer limit. Cosmetic treatment is nail care; treating a disease is not, whatever the technique.

The Overlap With Aesthetics

West Virginia's aesthetics definition reaches the same anatomical boundary — hands, elbows, and feet up to and including the knee — for applying preparations and for rubbing, cleansing, exercising, beautifying or grooming.

The distinction between the two credentials is therefore not where on the body you work but what you do there. Aesthetics adds skin treatments, waxing and tweezing, body wraps and artificial eyelashes and eyebrows; nail care covers the nails and cosmetic treatment of the hands and feet.

The Crossover Licences

West Virginia's list of professional licences includes two crossover categories that show how it handles adding scope: a cosmetology crossover adds 300 hours of clipper cuts and face shaving to an 1,800-hour cosmetology licence, for 2,100 hours in total. There is no equivalent crossover from nail technician.
